LocalMart365 is a technology platform that connects buyers with independent, third-party vendors. We do not sell, manufacture, stock, ship, or deliver any product listed on this platform — not a single item.

  • •Every product listing on LocalMart365 is created and owned by an independent third-party vendor.
  • •All transactions, payments for products, deliveries, and disputes are strictly between the buyer and the vendor.
  • •LocalMart365 is not a party to any transaction between a buyer and a vendor and accepts no liability whatsoever for such transactions.
  • •We do not guarantee the quality, safety, legality, accuracy of description, or availability of any product listed on the platform.
  • •By using LocalMart365, you expressly acknowledge and agree that LocalMart365 bears no responsibility for any product you discover, contact a vendor about, or purchase through leads generated on this platform.

1. Acceptance of Terms

By accessing or using LocalMart365 ("the Platform", "we", "us", "our"), you accept and agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the platform.

2. What LocalMart365 Is

LocalMart365 is a hyperlocal discovery and listing platform. We provide technology tools — including stores, product listings, geolocation search, AI-powered search, and direct messaging — so that local businesses and individual sellers can reach buyers near them.

We are not a retailer, marketplace seller, e-commerce store, or distributor. We do not hold inventory, process product payments, arrange deliveries, or handle returns for any product listed on the platform.

The only payments processed by LocalMart365 directly are vendor subscription and addon pack fees — charges for using the platform itself — not for any product sold by a vendor.

3. Definitions

  • "Platform" — the LocalMart365 website and all related services
  • "Vendor" — a registered seller who creates stores and posts product listings on the platform
  • "Buyer" — any person browsing listings or contacting vendors through the platform
  • "Listing" — a product advertisement created and published by a Vendor
  • "Third-Party Vendor" — any independent individual or business that posts listings; they are entirely separate from LocalMart365
  • "Subscription / Addon" — a paid plan for platform access, not a purchase of any product

4. Third-Party Vendors — No Endorsement

Vendors on LocalMart365 are independent third parties. LocalMart365 does not employ, represent, endorse, or vouch for any vendor or their products.

We do not verify the accuracy of product descriptions, prices, photos, stock levels, or any other information provided by vendors. Such information is solely the responsibility of the vendor who posted it.

If you have a complaint about a product, its quality, non-delivery, or a transaction gone wrong — your recourse is with the vendor directly, not with LocalMart365.

LocalMart365 shall not be held liable for any loss, damage, injury, fraud, or dispute arising out of or in connection with any product listed or sold by a third-party vendor on this platform.

5. User Eligibility

To use LocalMart365, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into binding contracts
  • Provide accurate and complete registration information
  • Comply with all applicable laws and regulations in India

6. Vendor Responsibilities

6.1 Account & Registration

  • Provide accurate business name, contact details, and location
  • Keep account credentials secure; you are responsible for all activity under your account
  • Notify us immediately of any unauthorised access

6.2 Listing Requirements

  • Provide accurate, truthful, and complete product descriptions
  • Upload genuine, original photos of the actual product
  • Set fair and honest prices — no hidden charges
  • Keep listing availability up to date; remove or mark sold-out items promptly
  • Ensure you are legally entitled to sell the product
  • Comply with all applicable laws including consumer protection and GST regulations

6.3 Prohibited Listings

Vendors must not list:

  • Counterfeit, pirated, or trademark-infringing products
  • Illegal goods or substances
  • Weapons, explosives, or hazardous materials
  • Products that violate any law of India
  • Any item the vendor does not actually possess or have the right to sell
  • Misleading or fraudulent product representations

7. Buyer Responsibilities

As a buyer using LocalMart365, you acknowledge and agree that:

  • You must independently verify product details, quality, and the credibility of the vendor before making any purchase
  • Any purchase you make is a direct transaction between you and the vendor — LocalMart365 is not a party to it
  • You assume full responsibility for any transaction you choose to enter into with a vendor
  • You will comply with all applicable laws regarding the products you purchase
  • LocalMart365 cannot and will not intervene in disputes between buyers and vendors

8. Platform Subscription & Addon Packs

8.1 What You Are Paying For

Vendor subscription and addon pack payments are fees paid to LocalMart365 for the use of the platform — the ability to create stores, post listings, and access platform features. These are not payments for any product.

8.2 Default Limits on Registration

  • New vendors are activated immediately with 2 stores and 48 listings at no charge

8.3 Addon Packs

  • Store Addon: ₹50 — adds +1 store and +50 listings to your account
  • Addons are applied instantly upon successful payment verification

8.4 Payment Terms

  • All platform payments are processed securely via Razorpay
  • Subscription and addon fees are non-refundable once activated
  • LocalMart365 is not responsible for any failed or disputed payments beyond the platform fee itself

9. Referral Program

  • Each vendor receives a unique referral code (format: LM + 7 digits) on registration
  • When a new vendor registers using your referral code, you receive +2 additional listing slots
  • Referral bonuses are non-transferable and have no cash value
  • LocalMart365 reserves the right to modify or discontinue the referral program at any time

10. Content Moderation

LocalMart365 reserves the right to:

  • Review, moderate, or remove any listing at any time without prior notice
  • Suspend or permanently terminate accounts that violate these terms
  • Refuse service to any user at our sole discretion

The following content is strictly prohibited on the platform:

  • False, misleading, or fraudulent information
  • Offensive, obscene, or hateful content
  • Spam, duplicate, or artificially inflated listings
  • Content that infringes on intellectual property rights
  • Malicious links or harmful code

11. Intellectual Property

All platform content including logos, design, software, and text is owned by LocalMart365 or its licensors and is protected by applicable intellectual property laws.

Vendors retain ownership of their listing content but grant LocalMart365 a non-exclusive, royalty-free licence to display, index, and promote their listings on the platform and in related marketing materials.

12. Disclaimer of Warranties

The platform is provided "as is" and "as available" without any warranties of any kind, express or implied. LocalMart365 does not warrant:

  • The accuracy, completeness, or reliability of any listing or vendor information
  • The quality, safety, legality, or fitness for purpose of any product listed
  • That any vendor is legitimate, trustworthy, or will fulfil their obligations
  • Uninterrupted, error-free, or secure access to the platform
  • That search results or recommendations will meet your specific needs

13. Limitation of Liability

To the maximum extent permitted by applicable law, LocalMart365 shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

  • Any product purchased from, or transaction entered into with, a third-party vendor
  • The quality, safety, legality, or non-delivery of any product
  • Fraudulent, misleading, or inaccurate representations made by vendors
  • Disputes between buyers and vendors
  • Loss of data, revenue, or profits from use of the platform
  • Unauthorised access to or alteration of your account
  • Any conduct or content of any third party on the platform

In any event, LocalMart365's total liability to you shall not exceed the amount you have paid to LocalMart365 (platform fees only) in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless LocalMart365 and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including legal fees) arising from your use of the platform, your listings, your transactions with other users, or your violation of these Terms.

15. Account Termination

15.1 By You

You may request account deletion at any time by contacting support. No refunds will be issued for unused platform subscription or addon credits.

15.2 By Us

We may suspend or terminate your account immediately and without notice if:

  • You violate any provision of these Terms
  • You engage in fraudulent or deceptive activity
  • You post prohibited content
  • Required by applicable law or court order

16. Privacy

Your use of LocalMart365 is also governed by our Privacy Policy. Please review it to understand how we collect, use, and protect your data.

17. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.

18. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to the platform. Your continued use of LocalMart365 after any modification constitutes your acceptance of the revised Terms.

Your Acknowledgement

By using LocalMart365, you confirm that you have read and fully understood these Terms and Conditions. You acknowledge that LocalMart365 is a listing platform only, that all products are listed and sold exclusively by independent third-party vendors, and that LocalMart365 bears no responsibility for any product, transaction, or dispute between buyers and vendors. If you do not agree, please discontinue use of the platform immediately.
